TERMS OF SALE

These terms will apply to all purchases of goods when you order via our website. (www.laykh.com)

SCOPE

These Conditions and any matters referred to on our receipt form the entire understanding between you and us and supersede any prior promises, representations (unless fraudulent) or undertakings. Any omission or error in any sales literature may be corrected by us without liability.

ORDERS

·       Before you submit your order, you will be given the opportunity to review your selection, check the total price of your order and correct any input errors.

·       Please be advised that exotic leathers are all natural products. No two skins are identical in pattern or pigment therefore no two bags will be identical. Pictures are for reference only.

·       Gift wrapping is available for all orders and will include a hand written card with your message. Please enter your gift message in the special instruction box at checkout

·       Should you have any questions pertaining to existing orders please contact us on love@laykh.com

PRICE

·       All prices are in American Dollars (USD).

·       If an error is found in the price of goods you have ordered we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, we will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

·       In addition to the price of the goods, should you will be required to pay a delivery charge it will be informed of the delivery charge payable when you place your order. The amount of the delivery charge will vary depending on the value of your order and your delivery location.

PAYMENT

·       Payments are taken online via the Shopify Payment of your choice.

·       Your order will only be processed once your full payment has been received

SECURITY

·       Rest assured your credit card and order data is encrypted and secure. We have 128 bit SSL certificates to ensure our order details are secure. If you have any questions regarding our site security, please email love@laykh.com

DELIVERY

·       Goods will only be dispatched by us to you after receiving your payment.

·       You order will be delivered to the address which you provide to us when you place your order.

·       For security reasons all purchases will require a signature upon delivery. Purchases may not be shipped to PO boxes or AFO/FPO addresses.  If there is no one at the address given to accept delivery of the goods, you will be asked to contact our courier service in order to collect the goods or arrange an alternative delivery date.

·       We shall repair or replace, free of charge any Goods damaged or lost in transit where delivery has been made by our carrier.

·       Due to Agricultural Laws – we are unable to ship to python to California and Thailand and all leathers to India

REPAIRS & DAMAGES

Should you wish to repair your purchase at anytime please contact Laykh on kash@laykh.com with a detailed description of what you would like repaired. Our Team will be in contact with you with an estimation of costs and lead time.

REFUNDS

If you are unhappy with your product please email kash@laykh.com within and up to 48 hours after delivery let’s see what we can do for you.  All bespoke orders are final.

LIMITATION OF LIABILITY

We will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the Contract for:

Any losses which are not reasonably foreseeable by both Parties when the Contract is formed arising in connection with the supply of Goods and related services or their use by you;

Any losses which are not caused by any breach by us; Business or trade losses.

Our entire liability in connection with the Contract will not exceed the purchase price of the Goods in question.

INTELLECTUAL PROPERTY

All Laykh designs, logos, trademarks, illustrations, images which appear on our products, accessories or packaging, whether registered or not and figurative or not, are and remain the exclusive property of Laykh, a company incorporated in Hong Kong (Business Registration: 50057900-00012-08-5 ) 

Any reproduction for whatever reason and in whatever medium, without our written, express and prior agreement, is strictly prohibited, as is any combination or use in conjunction with any other mark, symbol, logo and more generally any distinctive sign intended to form a composite logo.

DELAY OR FAILURE TO PERFORM

We shall not be liable to you if we are prevented or delayed in the performance of any of our obligations to you if this is due to any cause beyond our reasonable control including (without limitation): An act of God, explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure of our supplier(s); failure by you to give us a correct delivery address or notify us of any change of address.  We will inform you of any such unforeseen event or of force majeure within seven days of its occurrence.

USE OF YOUR INFORMATION

Laykh recognizes the importance of protecting the privacy of personal and financial information. We collect personal data from visitors to the website who register their information or who use the online store.

With your consent, Laykh will use this information to keep you informed of our special events or promotions, to register you with our website, to administer our website services, and/or to process any orders you may place online. Otherwise, we may use the information you provide to us only to review our performance and to improve our services to you, or to communicate with you about your order if you have placed an online order. 

Laykh does not sell, rent or disclose our client’s names, addresses, email addresses or other personal information to any entity. We do not disclose your information to third parties, unless we are required to do so by law or in connection with a legal claim or proceeding.

Laykh is hosted on a VPS. While we take reasonable steps to protect this personal information from unauthorized access, use or disclosure, you accept that no Internet data transmission can be guaranteed to be secure from access by unintended recipients. 

We will not be held us responsible for any breach of security unless this breach is due to our negligence.

You are entitled to request access to and correction of all personal data, all comments, queries or requests relating to our use of your information are welcome and should be addressed to love@laykh.com

GOVERNING LAW

The contract is governed by the laws of Hong Kong.   No waiver by us of any breach of the Contract by you is considered as a waiver of any subsequent breach of the same or any other provision.
